Buzztime and DEX Text-To-Win Challenge Official Rules
1. NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. Opting in for continued messaging from the Sponsors will not increase chances of winning. THE BUZZTIME AND DEX TEXT-TO-WIN CHALLENGE (“Promotion”) is sponsored by NTN Buzztime (“Buzztime”) and Dex Media, Inc. (DEX) (collectively referred to as “Sponsors”). The geographic scope of the Promotion is the following Designated Market Areas (DMAs): Minneapolis, Seattle, Chicago, and Phoenix. Standard text messaging rates apply.
2. Promotion is subject to all federal, state and local laws. Void where prohibited by law. BY ENTERING, PARTICIPANTS AGREE TO THESE OFFICIAL RULES:
3. Promotion begins on September 30, 2009 at 12:00 p.m. local time and ends on October 27, 2009 at approximately 12:00 a.m. local time. All entries must be received by Sponsors by October 27, 2009 no later than 12:00 a.m. local time. Sponsors’ computer is the official time-keeping device for this Promotion. A random drawing to select two winners each week from the four (4) DMAs listed above will be conducted on October 7, 2009; October 14, 2009; October 21, 2009 and October 28, 2009. Sponsors may change or cancel one or more dates or DMAs without notice.
ELIGIBILITY
4. All participants must be at least eighteen (18) years old and legal residents of United States at the time of entry. Employees of Sponsors and their immediate families (defined as spouse, parent, child or sibling), are not eligible to enter or win.
TO ENTER
5. Users will be prompted by messages on-screen at designated Buzztime sites to enter this Promotion. To enter the Promotion, be at any of Buzztime's sites located within the Seattle, WA; Minneapolis, MN; Chicago, IL; and Phoenix, AZ DMAs and text in the corresponding trigger code when prompted either by: (a) texting DEX1, DEX2, DEX3 or DEX4 to 82672 (answering the trivia question is optional); or (b) emailing advertising@buzztime.com with your name, age, address, phone number and date and location of Buzztime site where you saw the Promotion details; or (c) mailing a 3x5 piece of paper with your name, age, address, phone number and date and location of Buzztime site where you saw the Promotion to: Netinformer/Buzztime c/o Media General, 200 South Parker St., Tampa, FL 33606. No other entry method will be accepted. Text entries will receive a text message confirming registration. Text and email entries will only be accepted between 12:00:00 p.m. and 2:00:00 a.m. and only via the methods described above. Regular mail entries must be received by 10:00 a.m. ET on October 6, 2009; October 13, 2009; October 20, 2009 and October 27, 2009.
Participants who fail to provide all the required information will not be notified of the failure by the Sponsors and may be disqualified without notice. All entries become the property of Sponsors and will not be returned. There is no limit for entries per person and per household.
WINNER SELECTION
6. At approximately 5:00 PM ET, on October 7, 2009; October 14, 2009; October 21, 2009 and October 28, 2009 two (2) entries per Designated Market Area will be randomly selected from all entries timely received in each DMA. The odds of being selected as a winner depend on the number of entries received.
7. As a condition of receiving a prize, potential winners may be required to: (a) verify their eligibility by providing Sponsors with valid government-issued photo identification showing name and address (b) sign and return an affidavit of eligibility and (c) sign and return other legal documents, including tax forms, a publicity release and a full and unconditional liability release supplied by the Sponsors, which, among other provisions, releases the Sponsors their subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons from any and all liability related to the Promotion, the Promotion and the receipt and use of the prize.
8. Notifications to potential winners may be sent, in Sponsors’ discretion, by mobile device text message, telephone, voicemail and/or regular mail to any address or phone number received from participant. In the event that potential winner (a) fails to respond to the Sponsors’ notification that they are a potential winner within forty-eight (48) hours, (b) fails to satisfy any eligibility criterion, verification request or condition described herein, (c) declines to accept the prize, or (d) is otherwise determined to be ineligible by Sponsors. Sponsors may in their discretion disqualify that individual and one (1) alternate potential winner will be randomly drawn and deemed the alternate winner provided s/he complies with all requirements and restrictions described herein. In the event that the first potential winner and alternate potential winner cannot be qualified as a winner for any of the above reasons, the prize will not be awarded.
PRIZES
9. Prizes: Two (2) StubHub gift cards valued at $250.00 each will be awarded, one card to each of 2 winners, per Designated Market Area a week at random for four (4) weeks for a total of thirty-two (32) gift cards. The approximate retail value of each prize is $250.00. Gift cards are subject to certain rules and restrictions generally applicable to StubHub gift cards. StubHub is not associated with this promotion. By accepting a prize, winners agree to these further rules and restrictions.
PRIZE RESTRICTIONS; TAXES; NO CASH VALUE
10. All details of prize awards shall be at Sponsors’ sole discretion. Winner assumes responsibility for any costs or expenses associated with the prize not explicitly outlined above, including but not limited to all federal, state and local fees and taxes (including income taxes), surcharges, transportation, and incidentals. All prize elements are provided “as is” with no warranty or guarantee, expressed or implied. Prize may not be extended, transferred, auctioned or redeemed for cash. No substitution of prize is permitted except that Sponsors may substitute prize or prize element of comparable value if they deem necessary. Any such changes prior to winner selection will be announced. Sponsors are not responsible for StubHub’s or any other prize supplier’s failure or delay in honoring or delivering any prize benefits.
MISCELLANEOUS
11. By participating in the Promotion or accepting a prize, Players agree that the Promotion may be televised and broadcast and agree to award Sponsors the right to publicize their names, photographs (including the use and appearance of winner's photograph on Sponsors’ web pages), likenesses, biographical information, email address, voices and details of winning for purposes of this and future promotions without further compensation, except where prohibited.
12. All federal, state and local laws apply. Sponsors shall be entitled to interpret these rules as it deems necessary — including but not limited to rules regarding entries, selection of players and winners, deadlines, prize restrictions, and eligibility — and all of Sponsors’ decisions are final and binding. Sponsors, their affiliates, subsidiaries or agencies will not be responsible for the inability to select players or winners because of equipment failure or data storage failure or other factors beyond the reasonable control of Sponsors. Sponsors reserve the right to cancel, terminate or suspend this Promotion or any part of this Promotion in the event of any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond their reasonable control, as determined by the Sponsors in their sole discretion.
13. Sponsors reserve the right to prohibit or disqualify any person(s) from participating in the Promotion if, in Sponsors’ sole discretion, such persons are or are attempting to tamper with the entry process or the operation of the Promotion, or if such person(s) shows a disregard for, or attempts to circumvent, these Rules, or acts:
(a) in a manner Sponsors determine to be not fair or equitable to other participants; (b) with an intent to annoy, threaten or harass any other participant or Sponsors; or (c) in any other disruptive manner. Any person attempting to defraud or tamper with this Promotion in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Any failure by the Sponsors to enforce any Rules or laws shall not constitute a waiver of such Rules or laws.
14. Sponsors reserve the right to correct typographical or clerical errors in any Promotion-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award only the stated number of prizes in accordance with the above-described judging method from all legitimate, unawarded, eligible prize claims.
15. Sponsors are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not received by the Sponsors by the deadline stated above. Sponsors are also not responsible for any injury or damage to any text messaging device, phone, PDA, computer, modem, monitor or other device as a result of participation in this Promotion or downloading of any software or materials.
16. By accepting a prize, winners agree that Buzztime is not responsible and will be held harmless by winner for any loss, injury, or damage to person or property due in whole or in part directly or indirectly to possession, acceptance, transfer, loss, use or misuse of any prize or participation in the Promotion.
17. For a copy of the Official Rules or the Winner’s List, send a self-addressed stamped envelope by mail to: Netinformer/Buzztime c/o Media General, 200 S. Parker St, Tampa, FL 33606 after the conclusion of the Promotion, specifying either “Winner’s List” or “Official Rules”. Final Winner’s List will be available after approximately October 31, 2009.
DISPUTES
18. By entering the Promotion, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, indirect, incidental, non-economic or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses.
19. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with the laws of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any other jurisdiction. Any legal proceedings arising out of this Promotion or relating to these Official Rules shall be instituted only in the federal or state courts located in San Diego County, California and the parties consent to mandatory jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules or the Promotion. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed as if the invalid or illegal provision were not contained herein.
