Rules

1. ELIGIBILITY: The competition (“Competition” or “Promotion”) is open to all current PlayersPlus members who are legal residents of the United States (excluding residents of Michigan) and twenty-one (21) years of age or older at the time of entry. Promotion is void in Michigan, Puerto Rico and where prohibited by law. Available at participating Buzztime locations only. Employees and directors of NTN Buzztime, Inc., (“Buzztime”) and its subsidiaries, franchisees, advertising and promotion agencies and their immediate families and/or those living in the same household are not eligible to participate in the promotion. All federal, state and local laws and regulations apply. By participating each player agrees to be unconditionally bound by these Official Rules and the decisions of Buzztime which are final and binding in all respects.


2. TIMING: The Promotion begins on Wednesday, September 9, 2009 at 12:00:01 a.m. Eastern Time (ET) and continues through Wednesday, October 28, 2009 at 11:59:59 p.m. ET.


3. TO PLAY: There are (2) ways to enter:
   a) Weekly – Play any Wednesday Night Football game on the Buzztime Sports Network between 5:00PM – 12:30AM local time and be entered into a drawing for 1 of 500 weekly Buzztime prizes. Weekly prizes to include t-shirts, hats and NFL.com gift cards. The Approximate Retail Value of the weekly prizes ranges from $5 to $100.
   b) Without purchase – To enter without purchase and without using the Buzztime Network hand print your name, complete address with zip code (no PO box), e-mail, day/evening telephone numbers with area code on a 3x5 card and mail in a #10 envelope to the Buzztime, Attn: Marketing, Wednesday Night Football Promotion, 5966 La Place Court, Suite 100, Carlsbad, California 92008-8830. Limit six (6) entries per person/household, per day. No copies or mechanical reproductions accepted. Only one card per envelope. More than six (6) entries from any person, address, or houesehold per day for the Promotion will void all entries from that person, address or household. Buzztime is not responsible for lost, late, illegible, incomplete or misdirected entries. All write in entries must be received at the Buzztime contest office not later than October 30, 2009. Mail-in entries will be entered into the weekly drawing for the date on which the entry is postmarked.

Winners will be selected in a series of random drawings from all eligible entries received each week of the Promotion on or about November 5, 2009. Non-winning entries from one week will not be carried over into subsequent drawings. Approximate Retail Values (ARV’s) on prizes are just that, approximations and are not guarantees of price or value. The total approximate retail value of all prizes available to be won each week is $3,200.

Prizes will be mailed to winners within 4 to 6 weeks of the drawing. Limit one (1) prize per person/household, per week. Prizes are not exchangeable, transferable, or redeemable for cash. Winners must agree to abide by any restrictions in connection with the prizes. Taxes, if any, are the winner’s responsibility. In the event of unavailability of prizes, Buzztime, in its sole discretion, reserves the right to substitute a prize of comparable value. Buzztime is not responsible for any late, lost, undeliverable or misdirected prizes. Unclaimed prizes will not be awarded.


4. ODDS OF WINNING: Odds of winning a prize is determined by the number of eligible entries received each week.


5. USE OF NAME, PHOTO, IMAGE AND LIKENESS: By acceptance of prize, winners consent to the use and publishing of their individual name, home town, likeness, photograph or image, and voice by Buzztime for promotional purposes in all manner and media formats worldwide, in perpetuity, without further compensation to participants individually or jointly, unless prohibited by law.


6. GENERAL: By participating in the Promotion, entrants agree to be bound by these Official Rules and by the decisions of Buzztime which are final and without recourse. This Promotion is subject to the laws of the United States.  Void where prohibited by law. Buzztime broadcast schedule subject to change at the discretion of Buzztime. By accepting a prize, winners agree that Buzztime is not responsible and will be held harmless by winner for any loss, injury, or damage to person or property due in whole or in part directly or indirectly to possession, acceptance, use or misuse of any prize or participation in the Promotion. All federal, state and local taxes are the responsibility of the winner. Buzztime is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions, or technical failure, jumbled, scrambled or misdirected transmissions or other errors of any kind whether human, mechanical or electronic. Any Buzztime hospitality location whose VSAT connection, DSL connection or telephone line is not working properly may forfeit its players’ chances to win. VSAT locations are not eligible to participate in the Promotion. Attempts, as solely determined by Buzztime, to abuse, cheat, circumvent, manipulate data and entries will result in participant disqualification. In the event that the operation of the Promotion is compromised due to virus, bugs, non-authorized human intervention or any other causes beyond the control of Buzztime which corrupts, or impairs administration, security, fairness or proper conduct of the Promotion, Buzztime reserves the right, in its sole discretion, to suspend, modify or terminate the Promotion in its entirety and to disqualify any individual who tampers with the entry process.


7. ARBITRATION/CHOICE OF LAW: (a) Except where prohibited by law, you as a participant agree that (1) any and all claims, disputes and causes of action relating directly or indirectly, to the Competition, and use of the Buzztime equipment and programming shall be resolved individually, without resort to any sort of class action and exclusively by arbitration or alternative dispute resolution as selected by Buzztime to take place in the county of San Diego, California, (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, but in no event attorney’s fees; and (3) in no event will a participant be entitled to obtain additional awards beyond out of pocket costs and participants hereby waive all rights to claim punitive, incidental and consequential damages, other than for actual out of pocket costs and hereby waives any and all rights to have damages or awards multiplied or otherwise increased. Except where prohibited, all issues and questions regarding the Competition and interpretation and validity of these “Official Rules” and the decisions of Buzztime and its agents in connection with the Competition shall be governed by the laws of the State of California without regard for conflict of laws doctrine. (b) Should any term of this rule or any other rule, term or condition of these Official Rules and any addendum or published notice referenced in these Official Rules be determined to be void, unenforceable or contrary to applicable law, such terms or conditions shall, but only to the extent necessary to bring the rule within the requirements of the law, be deemed to be severed from the other terms and conditions hereof and the remainder of the Official Rules shall remain in full force and effect.


8. WINNERS LIST: The names of the winners will be posted on www.buzztime.com/wednesday-night-football at the conclusion of the Competition for a limited time.  To obtain a copy of the winners list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Buzztime, Attn: Marketing, Wednesday Night Football Promotion, 5966 La Place Court, Suite 100, Carlsbad, CA 92008-8830. Requests must be received no later than November 1, 2009.
