California Consumer Privacy Act (CCPA)

Your privacy rights and choices under California law

Introduction

The California Consumer Privacy Act of 2018, and its implementing regulations ("CCPA"), requires certain notices and provides specific rights to California residents, which are detailed below. This California Notice of Collection and Privacy Supplement ("CA Supplement") is applicable only to California residents. It supplements our U.S. Privacy Policy ("Privacy Policy") which also governs our use of your Personal Information. Capitalized terms that we do not define in this CA Supplement have the meanings set forth in our Privacy Policy.

California Notices and Rights

If you are a California resident, you have certain rights with respect to your Personal Information:

A. Notice at Collection

At or before the time of collection of your Personal Information, you have a right to receive notice of our practices. We provide this notice through our Privacy Policy and this CA Supplement, links for which appear at the bottom of our websites, in our apps and other Services and on sign up and registration pages for our Services. The notice includes the categories of Personal Information and sensitive Personal Information we may collect, the purposes for which such information is collected or used, whether such information is "sold or shared" as defined under California law and how long such information is retained.

B. Notice of Financial Incentives

When you enter or sign up for contests, sweepstakes, or other special promotions that we and our partners may offer or if we offer loyalty programs in connection with any of our Services, we may require you to provide certain Personal Information as a condition of entering or signing up. These contests, sweepstakes, other promotions and loyalty programs may be considered a "financial incentive" or similar program under California law.

As further described in our Privacy Policy, we use the information we collect for the purposes described in the Privacy Policy and may share the information we collect with third parties, including without limitation contest sponsors, service providers who support the operation of the program, advertising partners, and social media platforms.

We believe that the value of any financial incentive we provide is reasonably related to the value of any Personal Information you provide to us. This value relates to a number of factors including, without limitation, our operating expenses in running the contest, sweepstakes or other promotion including those incurred from collecting your Personal Information, costs of providing the financial incentive to you, any revenue generated through the contest, sweepstakes or other promotion including through your use of the financial incentive, and any improvements to our Services based on information obtained through the financial incentive program.

There are often additional terms and conditions applicable to a financial incentive offer, which, if applicable, will be provided to you when you sign up. You may exercise your rights with respect to any information you provide us as described at Your Privacy Choices.

C. Other Privacy Rights

1. Right to Know/Access, Correction and Deletion

Subject to certain exceptions, you have the right to:

  1. request that we disclose to you the Personal Information we have collected about you.
  2. (where we process your information by automated means) request and obtain a copy of your Personal Information that you previously provided to us in a portable format, and to the extent technically feasible, to obtain your Personal Information in a readily usable format that allows you to transmit the Personal Information to another data controller.
  3. request additional information about our collection, use, disclosure, or sale of such Personal Information.
  4. request that we correct inaccurate Personal Information.
  5. request that we delete Personal Information under certain circumstances.

You may only make a request for access (copies) of your information or data portability twice within a 12-month period.

2. "Do Not Sell or Share My Personal Information"

You have a right to opt-out from the "sale" or "sharing" of your Personal Information with third parties who are not our service providers as those terms are defined under the CCPA). To exercise this right, click on the button below, go to Your Privacy Choices or Contact Us.

3. Right to Limit Use and Disclosure of Sensitive Personal Information

You have a right to limit our use of sensitive Personal Information for any purposes other than to provide the services or goods you request or as otherwise permitted by law. To exercise this right, please go to Your Privacy Choices or Contact Us.

4. Non-Discrimination

You have the right not to be treated in a discriminatory manner simply because you exercise any of your rights. If you choose to exercise any of the privacy rights described above, we will not deny our Services to you (unless specifically related to your request, such as deletion of your account, data or cancellation of your Services), charge you different prices or provide a different level or quality of products or services to you unless those differences are related to the value of your Personal Information.

5. Do Not Track and Global Privacy Controls

We honor Do Not Track (DNT) and Global Privacy Control (GPC) signals as required by law. For more information about how to turn on DNT and GPC in your browser or device, please see Do Not Track (DNT) and Global Privacy Control Settings in our Privacy Policy.

Privacy Request Verification and Authorized Agents

A. Verification

To exercise any of the rights described above in Sections I.C(1), (2) or (3), please submit a "verifiable consumer request" to us by filling out our webform at Your Privacy Choices or by contacting us as provided in Contact Us.

A verifiable consumer request is subject to the following: The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or that you have authorized a representative to act on your behalf. This means that in making a request you may be required to: provide your email and/or phone number, address, customer information, and/or account sign-up authentication or other information needed to verify your identity depending on the sensitivity of the Personal Information that is the subject of the request. In certain cases, you may also be required to submit photo identification that matches your name.

We cannot respond to your request or provide you with Personal Information if we cannot (a) verify your identity or authority to make the request and (b) confirm the Personal Information relates to you. If we are unable to verify your identity, we reserve the right to deny the request.

Making a verifiable consumer request does not require you to create an account with us.

We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

B. Authorized Agents

If you choose to use an authorized agent to submit a request to know/access, to correct or to delete your information, we may require that you: (1) provide the authorized agent written permission to do so; and (2) verify your own identity directly with us. We will not require these steps if we have received proof that you have provided the authorized agent with a power of attorney pursuant to California Probate Code sections 4000 to 4465. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf. We may also deny a request from an agent that does not meet the requirements for authorized agents under the CCPA.

C. Automated Requests and Bots

To protect your data, at this time we do not honor automated or bot-generated data subject requests or account and subscription cancellation requests as they cannot be verified. To ensure that your request is legitimate and securely processed, we require that the requests be submitted by you or your authorized agent, following appropriate verification set forth above.

D. Response to Your Request

Once we have verified your identity (and/or your authorized agent, as applicable), we will respond to your request as appropriate. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request. If we are unable to complete your request in whole or in part, we will let you know why.

1. Response Timing and Format

We use good faith efforts to respond to a verifiable consumer request within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the needed extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by email.

Any disclosures we provide will only cover the 12-month period preceding our receipt of the verifiable consumer request.

If we cannot comply with any portion of a request, the response we provide will also explain why, if applicable.

For access and data portability requests, we will select a commercially reasonable format to provide your Personal Information that is commonly useable, and we believe in good faith should allow you to receive or, as applicable, transmit the information from one entity to another entity without hindrance, but we do not guarantee that all formats are useable in all media.

2. Fees

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Records of Processing and California Metrics

Under the California Consumer Privacy Act (CCPA), and the California Privacy Rights Act (CPRA), Buzztime is required to publish annual statistics on the privacy requests we receive and process. This includes requests to access, delete, correct, and limit the use of personal information, as well as opt-out requests for the sale or sharing of personal information. These disclosures help consumers understand how businesses are handling their data and ensure transparency in privacy practices.
